How To Get Arms License In India.

INTRODUCTION:

An arms license is an official document awarding a person the right to own and use a firearm, usually subject to certain restrictions.  The National Database of Arms Licenses-Arms License Issuance System (NDAL-ALIS) is a portal created by the Ministry of Home Affairs to assist business owners and businesses in license applications related to the production of ammunition and arms. The following article gives a thorough description and process for acquiring an arms license.

ARMS LICENSE:

Who can apply for an arms license in India?

  • In India, the definition of a gun licence is governed by the Arms Act of 1959.
  • Any Indian citizen who wishes to own a firearm may only purchase NPB firearms.
  • This act includes a provision that allows civilians to obtain the authority to possess a firearm if they face serious danger to their life.

NDAL-ALIS

National Database of Arms Licenses-Arms License Issuance System (NDAL-ALIS)

  • It is a portal created by the Ministry of Home Affairs to assist business owners and businesses in license application related to the production of ammunition and arms.
  • It also includes individuals in implementing for arms licences under the Arms Act of 1959 and the Arms Rules of 2016. This portal provides 29 services to candidates.
  • This amenity boosts the Government of India’s Make in India policy by boosting the convenience of doing business.

Purpose:

  • An arms licence is a licence or permission granted by a government authority (usually the police) of a jurisdiction allowing the licensee to purchase, acquire, possess, or carry a firearm, frequently subject to a variety of conditions or limitations.
  • The Arms Rules, 2016 require that the UIN (Unique Identification Number) be stated on the Arms Licence granted by the Licensing Authority. There is no legal licence without the UIN.

ELIGIBILITY CRITERIA:

  • Every producer wanting to apply for a new licence under these rules must be an Indian company incorporated under the Companies Act, 2013 (18 of 2013).
  • It is necessary that the applicant company is owned and controlled by resident Indian citizens or,
  •  Indian companies owned and managed by resident Indian citizens, except in the case of a company with Foreign Direct Investment (FDI) in excess of 49 percent; and provided further that the company’s Chief Executive is a resident Indian citizen.
  • Every individual, sportsperson, and institution asking for a renewal of an arms licence on FORM II, III, IV, and V under A2/ A4 of the Arms Rules 2016.
  • Every individual/firm applies for a new weapon dealer licence on FORM VIII & VIII A under A6 in accordance with Schedule III of the Arms Rules 2016.

APPLICATION PROCESS:

  1. Original or official copies of the company’s founding documents, including Certificate of Registration, Memorandum and Articles of Association, of the company under the Companies Act, 2013 (18 of 2013), CIN (Corporate Identification Number), Permanent Account Number (PAN) card.
  • A copy of each director’s Director Identification Number (DIN):

It is a special identification number assigned to a person appointed as a director of a company.

  • Identity proof, including two most recent pictures, of all executives and the responsible person as follows:

1. Aadhar Card; or

2. if the director or the responsible person does not have an Aadhar Card, a written declaration in the way of an Affidavit to be given in this respect, along with a substitute identification proof.

  • Alternative residence proof must be submitted if the director or responsible person does not have an Aadhar Card or a Passport. These include a Voter’s Identity Card, an Electric Bill, a Landline Telephone Invoice, a Rent Deed, a Lease Deed, Real estate documents, or any other satisfactory supporting documents.
  • A replicate of the industry’s most recent balance statement and an audited copy of the Net-worth certificate suitably certified by a Chartered Accountant;
  • Certified copy of the board resolution for making an application under these rules, along with complete particulars of the responsible citizen allowed to sign the same;
  • Foreign management and/or ownership data of the applicant firm, if relevant, duly attested by a Chartered Accountant;
  • Full information of the guns and/or explosives to be manufactured, proof-tested, or both, including kinds and amounts;
  • A proclamation with evidence that it has obtained the land for the purpose of establishing the production plant or the proof-test facility, as well as details of an access road to the proposed site, installation of electricity and any other information considered necessary by the licensing agency.

DOCUMENTS REQUIRED:

The following documents under rule 11 of the Arms Rules 2016 are to be submitted along with the application form –

  • 4 passport size copies of the latest photograph (in white background)
  •  Proof of date of birth
  •  Identification proof – Aadhar Card or if the individual does not have an Aadhar Card, a written statement in the manner of a Confirmation, attached with an alternate form of identity which may include ─, Voter ID, PAN Card, Passport or Identity card delivered to the personnel.
  • Proof of residence if the individual does not have an Aadhar Card or a passport (Election Card, Electricity or Landline Telephone Bill, Property papers or any other file being approved by the licensing authorities.)
  • Safe use and storage of firearms undertaking referred to in sub rule (4) in Form S-2
  •  For professional category, applicant self-attested copies of the educational and professional qualification certificates.
  •  Medical certificates about mental health and physical fitness (in Form S-3)
  •  In case of protection for destruction of wild animals which do injury to human being or cattle and damage to crops, permit from the authority empowered under the Wild Life (Protection) Act, 1972.

Latest Arms Regulations News:

Every person asking for an arms licence must now complete a firearms safety training course. This training will cover safety fundamentals such as-

  • Handle with caution.
  • Method of firing.
  • The whole procedure for their storage or transit.
  • The authority further says that the guns licence will be granted to persons who face great and imminent danger to their lives as a result of living in their region or zones where extremists are most active.
  • The licence authority can now issue or refuse to award the licence within 60 days.
