SEBI Registered Investment Adviser

India in past two decades has witnessed an enormous amount of Positive growth in financial and Investment sectors along with regulatory and legal shift. People are thriving towards investment in purview of the awareness and efforts of regulatory bodies in India. In light of the financial growth the profession of Investment Adviser (IA) is also blooming up. Any person wishes to carry on the business of Investment Adviser (IA) is required to get themselves registered with SEBI following all the eligibility and requirements laid down.

Who is investment Advisor?

An Investment Adviser means any person engaged in the business of providing Investment advisory service to clients and Individuals in leu of consideration in cash or kind.

Who can apply for Investment Adviser (IA) License?

  • Individuals and Firms
  • Body Corporate Including LLP

In order to get the License one is required to follow the procedure as laid down which is inclusive in nature and includes:

  1. Qualification

It is pertinent to note that qualification is the most important criteria before heading with the application whether the application is made as an individual or Non Individual (Principal Officer).

As per regulation 7 of SEBI (Investment Adviser)(Amendment)Regulations, 2020 an individual or Non Individual (Principal Officer) shall have the following minimum qualifications , all the time :

  • A professional qualification with minimum 2 years in finance, accountancy, business management, commerce, economics, capital market, banking, insurance or actuarial science; or
  • a professional qualification by completing a Post Graduate Program NISM of a duration not less than one year; or
  • A professional qualification by CFA Institution.
  1. Experience

An individual or Non Individual (Principal Officer) shall have an experience of 5 years in activities pertaining to Advise in Financial Products or securities or assets or Portfolio management .

However, person associated with Investment Adviser (IA) must have an experience of 2 years in activities pertaining to Advise in Financial Products or securities or assets or Portfolio management.

  1. Certification

An individual or Non Individual (Principal Officer) shall have a certificate in financial planning or securities or assets or Portfolio management from:

  • NISM
  • Any other organization or institution including Financial Planning Standards Board of India or any recognized stock exchange in India provided such certification is accredited by NISM.
  1. Net Worth
IndividualsNon Individuals
Net worth in form of tangible assets should not be less than 5 lakhs
(Obtained by Practising chartered Accountant )
Not less than 50 lakhs

  1. Infrastructure

The applicant should have an adequate infrastructure which shall include office space, office equipment, furniture and fixtures, communication facilities, research capacity, research software for undertaking investment advisory services.

Once the above requirements are fulfilled one can proceed with application to SEBI, and process can be started in approval with BASL (BASL Membership Registration). Once BASL sends approval email asking to proceed with application to SEBI one is supposed to login to   https://siportal.sebi.gov.in/intermediary/index.html and complete the initial application process.

Post initial application process fill form A with all the necessary details and attachments as required by the SEBI.

Upon SEBI being fully satisfied with your application, will ask you to make payment to the BASL.

SEBI on receiving approval from BASL and payment of requisite fees will approve the License and issue the License while BASL will issue the certificate of membership.
